Terms of Service
The terms that govern your access to and use of Aery.
1. Agreement
By using Aery, you agree to these Terms of Service and our Privacy Policy. If you are using Aery on behalf of an organization, you represent that you have authority to bind the organization.
2. Access and use
- Keep your account credentials confidential.
- Comply with applicable laws and third-party rights.
- Do not attempt to disrupt or misuse the Service.
3. Customer content
You own your content and are responsible for it. You grant Aery a limited license to process content solely to provide and improve the Service, and as otherwise permitted by law.
4. Acceptable use
- No unlawful, harmful, or infringing content.
- No unauthorized data collection or sharing.
- No attempts to reverse engineer or circumvent security.
5. Availability and support
We strive for high availability but do not guarantee uninterrupted service. We may make changes, suspend, or discontinue features.
6. Subprocessors and integrations
We use vetted subprocessors to provide the Service. Integrations you enable (e.g., HubSpot, Salesforce) are governed by their own terms.
7. Fees
Paid plans bill in accordance with the order form or plan page. Fees are non-refundable unless required by law or stated otherwise.
8. Confidentiality
Each party may receive confidential information from the other. Neither party will disclose it except to employees, contractors, or subprocessors with a need to know and subject to obligations of confidentiality.
9. Intellectual property
Aery retains all rights in and to the Service and underlying IP. No rights are granted except as expressly set forth in these terms.
10. Disclaimers
The Service is provided “as is” without warranties of any kind. To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the extent permitted by law, Aery and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data.
12. Term and termination
Either party may terminate for material breach if not cured within a reasonable period after notice. Upon termination, your access ends and certain sections will survive.
13. Governing law
These terms are governed by the laws of the jurisdiction disclosed in your order form or, if none, the state of Delaware, USA.
14. Changes
We may update these terms as the product evolves. We will post the latest version on this page with an updated effective date.
